These terms of use apply to the website sensetrails.com and to the mobile apps published by Sensetrails Sàrl, Villars-Champvent, Switzerland ("Sensetrails", "we"). By using our website or apps, you agree to these terms. If you download an app from the App Store or Google Play, that store's terms also apply.

Using our apps

We grant you a personal, non-exclusive, non-transferable licence to use our apps on devices you own or control, for your private, non-commercial use. You may not copy, modify, resell, decompile or reverse-engineer our apps, except where the law expressly allows it.

Purchases and subscriptions

Some apps offer paid features, one-time purchases or free trials. Purchases are processed by Apple or Google under their terms, including their refund policies. Prices are shown in the store before you buy. You can restore purchases on your other devices from within the app.

Health, sport and safety

Several of our apps relate to sport, outdoor activities and well-being. They are tools to help you prepare and learn; they do not replace proper training, certification, equipment, professional advice or your own judgement.

Diving. Dive planning is inherently risky. Always dive within the limits of your training and certification, cross-check plans with a second tool or tables, and dive with a dive computer. Diveplanner does not guarantee freedom from decompression sickness or other injuries.
Riding and outdoors. Trails and maps may be inaccurate or out of date. Check local conditions and rules, respect private property and nature, and ride safely.
Well-being. Our sound, breathing and aromatherapy apps are not medical devices and do not diagnose, treat or cure any condition. Ask a health professional if you have any doubt, especially during pregnancy, with children or if you have a medical condition. Do not use sound sessions while driving or operating machinery.
Finances. Our finance apps provide estimates for information only. They are not financial, tax or investment advice.

Your content

You keep all rights to the content you create in our apps (plans, logs, notes, photos, trails). If you choose to share content publicly through an app, you are responsible for it and must not share anything that is unlawful or infringes the rights of others.

Intellectual property

The apps, this website, their design, texts, graphics, logos and names are owned by Sensetrails or its licensors and are protected by intellectual property laws.

Availability and changes

We work hard to keep our apps and website available and up to date, but we cannot guarantee that they will always be error-free or available without interruption. We may change, update or discontinue features at any time.

Limitation of liability

Our apps and website are provided "as is". To the extent permitted by law, Sensetrails is not liable for indirect or consequential damages, or for damages resulting from the use of, or inability to use, our apps or website. Nothing in these terms limits liability for intent or gross negligence, or any rights you have as a consumer under mandatory law.

Privacy

We value your privacy. Please read our privacy policy to learn how we handle personal data in line with the Swiss FADP and the GDPR.

Governing law

These terms are governed by Swiss law. The courts of the canton of Vaud, Switzerland, have jurisdiction, subject to any mandatory jurisdiction available to consumers in their country of residence.
